Terms of sales and returns
The owner of the online store FLAMER.EE (hereinafter referred to as the Online Store) is Flamerest OÜ (registration code 17064145), located in Tartu County, Tartu Municipality, Kärevere Village, Metsanuka, 60603.
Validity of the Sales Contract, Product, and Price Information
The sales conditions apply when purchasing goods from the Online Store. The prices of the products sold in the Online Store are indicated next to the products. A fee for the delivery of the goods is added to the price. The delivery fee depends on the buyer's location and the method of delivery. The delivery fee is displayed to the buyer when placing the order. Information about the goods is presented directly next to the goods in the Online Store.
Order Placement
To order goods, you must add the desired products to the shopping cart. To place an order, you need to fill in the required fields and select a suitable method for delivering the products. The amount to be paid will then be displayed on the screen, which can be paid via a bank link or another payment solution. The contract comes into effect upon the receipt of the payable amount in the Online Store's bank account. If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid money (including delivery costs) will be refunded without delay, but no later than 14 days after the notification is sent.
Delivery
Goods are shipped to the following countries: the Republic of Estonia, the Republic of Latvia, and the Republic of Lithuania. The shipping costs are borne by the buyer, and the relevant pricing information is displayed alongside the shipping method. Domestic shipments within Estonia generally reach the destination specified by the buyer within 3-7 business days from the conclusion of the sales contract. For deliveries outside of Estonia, shipping takes 5-10 calendar days. In exceptional cases, delivery may take up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days. The right of withdrawal does not apply if the buyer is a legal entity. To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to verify the nature, properties, and functioning of the goods in a manner allowed for testing the goods in a physical store. If the goods have been used for purposes other than verifying their nature, properties, and functioning, or if there are signs of use or wear, the online store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods. To return the goods, a notice of withdrawal from the purchase must be submitted and sent to the email address info@flamer.ee no later than 14 days after receiving the goods. The buyer bears the cost of returning the goods, except when the reason for the return is that the item does not correspond to what was ordered (e.g., the wrong or defective item). The buyer must return the goods within 14 days of submitting the notice or provide proof that they have handed the goods over to the carrier within this period. Upon receiving the returned goods, the online store will refund the buyer all payments received under the contract without delay, but no later than 14 days from receiving the notice of withdrawal. The online store may withhold refunds until it has received the goods back or until the buyer provides proof that they have returned the goods, whichever occurs first. If the buyer has explicitly chosen a delivery method that is different from the cheapest standard delivery method offered by the online store, the store is not obligated to refund the cost that exceeds the cost of the standard delivery method. The online store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly lower than the market price due to an error.
Right to Make a Claim
The online store is responsible for any non-compliance with the contract terms or defects in the goods sold to the buyer that existed at the time of delivery and that become apparent within two years of the goods being handed over to the buyer. During the first six months of this period, it is presumed that the defect existed at the time of delivery. It is the responsibility of the online store to refute this presumption. If a defect is discovered, the buyer must contact the online store within two months by sending an email to info@flamer.ee.
The online store is not responsible for defects that arise after the goods have been delivered to the buyer. If the goods purchased from the online store have defects for which the online store is liable, the store will either repair or replace the defective item. If it is not possible to repair or replace the goods, the online store will refund all fees associated with the sales contract. The online store will respond to the buyer’s complaint in writing or in a format that allows for written reproduction within 15 days.
Dispute Resolution
If the buyer has complaints regarding the online store, they should be sent to the email address info@flamer.ee. If the buyer and the online store are unable to resolve the dispute through mutual agreement, the buyer may turn to the Consumer Disputes Committee. The procedural conditions can be reviewed and applications submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the online store. The examination of the buyer's complaint by the committee is free of charge. The buyer may also contact the European Union's platform for resolving consumer disputes.
